Terms of Service

1. Definitions

These words carry the following meanings throughout this page.

• “The service”: the Discord bot, the web dashboard, this site, and everything that follows from them.
• “The bot”: the Discord application you add to your server, in any of its editions.
• “The dashboard”: the web panel where you configure your server.
• “The server”: a Discord server the bot has been added to.
• “Server owner”: whoever owns the server on Discord, and anyone they grant management rights to.
• “Member”: any user in a server where the bot is running.
• “Edition”: the subscription level — FREE, PLUS, PRO or ULTRA.
• “We”: the operator of the service, referred to on this page as Kivo Bot.

2. Accepting these terms

By using the service in any way — signing in to the dashboard, adding the bot to a server, or running one of its commands — you accept these terms and the privacy policy that goes with them.

If you are adding the bot on behalf of an organisation or a team, you confirm that you are authorised to accept these terms on its behalf.

If you do not accept any clause here, the remedy is not to use the service and to remove the bot from your server.

3. Eligibility

The service runs on top of Discord, so Discord's terms apply to you before ours do. Breaking theirs breaks ours.

• You must be at or above the minimum age Discord requires in your country.
• Your Discord account must be a real account that has not been terminated for a violation.
• You must hold the Manage Server permission in any server you add the bot to.

4. Your account and signing in

We never create a password for you and never ask for one. Signing in happens through Discord's own OAuth flow, and you approve the scopes on Discord's screen before we receive anything.

You are responsible for keeping your Discord account secure. Anything done from your account is treated as done by you. If you lose control of it, tell us immediately through the support server.

We keep the access and refresh tokens Discord issues us, encrypted, and use them only for what you approved: your identity and the list of your servers.

5. Adding the bot to your server

The bot never joins a server unless you add it. We do not add it ourselves, we do not enter your server, and we do not change its configuration beyond what you set in the dashboard.

On being added, the bot asks for the Discord permissions its features need. You may narrow them; the features that depend on what you narrowed then stop, and the bot names the missing permission rather than failing silently.

Every feature is off when the bot arrives, apart from the starter set. Nothing runs in your server because we decided it was useful.

6. Editions and what each one opens

There are four editions. The free one opens the core features in full; the paid ones open additional parts inside those features and raise some limits.

• Prices are in US dollars and may change in future, with notice on the site.
• A price change does not apply to a paid subscription already running until its period ends.
• We may add, change or retire features. If we retire something substantial from a paid edition mid-period, contact us.

7. Payment and renewal

Payment goes through PayPal, which processes the transaction. We never see or store your card number or its details at any point.

Subscriptions are monthly and do not auto-renew. When the period ends the server returns to the free edition and stays there until you renew yourself. We never take money without you starting the transaction.

Paid time belongs to a specific server, not to your account. The same edition on two servers is two subscriptions.

• The edition takes effect once PayPal confirms the money was captured, not before.
• If PayPal declines or holds the payment for review, the edition does not open until confirmation completes.
• If a payment reverses after the edition opened — a refund or a dispute — we may return the server to the free edition.

8. Diamonds

Diamonds are an in-service balance an account earns through use and referrals, and can exchange for subscription time on some editions.

Diamonds are not a currency and have no monetary value. They are not sold or bought for money, not convertible to cash, not transferable on death, and not refundable. They have no published exchange rate outside the service.

• Selling or trading diamonds outside the service is not allowed, and we may zero the balance of anyone who does.
• Diamonds earned by cheating — fake accounts, manufactured referrals, exploiting a bug — are withdrawn, and the account may be suspended.
• The diamond ledger is cryptographically sealed, so any change made to it from outside the service is detectable.
• We may retire the diamond system or change its rates in future, and doing so is not a breach of these terms.

9. Refunds

The service is digital and opens the moment payment clears, so as a rule a payment is not refunded once the edition has opened.

• If you paid and the edition did not open because of a fault on our side, you get the full amount back.
• If a substantial feature of your edition was down for an extended period because of a fault on our side, contact us and we will look at the case.
• A refund because you changed your mind, or because a feature working as described was not to your taste, is not guaranteed.
• Opening a PayPal dispute without contacting us first may end with the service being suspended for your servers.

10. Acceptable use

By using the service you agree not to do any of the following.

• Use the bot in breach of Discord's terms or community guidelines.
• Use the moderation features to harass, stalk or defame anyone.
• Try to reach data for a server you have no permission in, or anyone else's account.
• Attempt to break the service, or to get around its limits or your edition's limits by any means.
• Send the service automated traffic at a volume that harms it or other users.
• Resell, rent or white-label the service without a written agreement with us.
• Use the service for unlawful activity, or for content that harms minors.
• Use the auto-posting features to send unsolicited advertising to members who did not ask for it.
• Evade a suspension we imposed by creating a new account or a new server.

11. What you write

Many of the bot's features display text you wrote: the welcome message, the rules text, custom command replies, auto replies, quiz questions, ticket prompts and more.

That text stays yours. You grant us a limited licence to store it and display it inside your server and its dashboard — a licence that exists because the feature cannot work without it, and that ends when you delete the text or remove the bot.

You are responsible for that text being lawful and for it not infringing anyone else's rights. We may remove text reported to us as infringing, or switch off the feature that displays it.

12. The shared question bank

The games feature reads from a question bank shared between servers. When your server writes a question into that bank, it becomes available to other servers using the same feature.

This clause is written out explicitly because it is the single exception to “your server's content stays in your server”. If you do not want anyone else reading your questions, do not write them into the shared bank.

We reserve the right to hide any question from the bank without notice: an offensive, wrong or rule-breaking question reaches servers that had no hand in writing it.

13. What a server owner is responsible for

The bot is a tool that carries out what you configured. The decisions it makes in your server — a ban, a kick, a mute, a deleted message, a granted role — are decisions you made when you set the rule that produced them.

• You answer to your members for your server's settings and for their consequences.
• You are responsible for telling your members that a bot is running and recording some of their activity, and for any legal obligation you owe them.
• You are responsible for whoever you grant dashboard access to, and what they do with it counts as yours.
• You are responsible for how the backup features are used: restoring a snapshot changes your server's structure.

14. The AI guard

If your server turns on the AI guard, the text of some messages the ordinary rules find suspicious is sent to an external provider for a verdict, and the verdict comes back to the bot.

The feature is off by default and does nothing until a server owner explicitly turns it on. What is sent and what is not is set out in the privacy policy.

A model's verdict is a suggestion, not a certainty. It can be wrong in both directions, which is why the consequential decisions stay behind a threshold the server owner sets, and why we make no guarantee about the accuracy of any verdict.

15. Games

The games in the service are for entertainment inside your server only. They pay no prize, no money, no diamonds and nothing else of value, and they accept no wager and no paid entry.

Points and rankings inside a game are worth something inside that server and nothing outside it.

16. Referrals

The referral system rewards people who bring new users. A referral counts once, only when the account is created, and never for an account that already existed.

• Referring yourself with extra accounts, buying referrals, or advertising your link in ways that annoy people is not allowed.
• Rewards are paid after verification, and we may delay or cancel one that looks manufactured.
• We may change reward values or end the programme, which does not affect a reward already paid.

17. Availability, and no warranty

We do what we can to keep the service running, but we do not promise uninterrupted availability or freedom from errors.

The service is provided “as is” and “as available”. We give no express or implied warranty that it is fit for a particular purpose, or that its results will be accurate or complete.

The service depends on Discord and on other providers. An outage at theirs is an outage at ours, and is not in our hands.

We may take the service down for maintenance or updates, and we try to do that at quieter hours.

18. Suspension and termination

You may stop using the service at any time by removing the bot from your server. We do not ask for a reason.

We may suspend an account or a server, or block it from the service, if it breaches these terms, breaches Discord's terms, harms the service or its users, or attempts fraud in payment, diamonds or referrals.

For a serious breach the suspension may be immediate and without prior notice. Short of that, we try to warn first.

A suspension for a breach carries no refund.

19. Limits of liability

To the fullest extent the law allows, we are not liable for indirect, consequential or incidental loss: lost profit, lost data, business interruption or reputational harm.

In any event our total liability to you for any claim does not exceed what you actually paid the service in the twelve months before the incident, or fifty US dollars, whichever is greater.

Nothing in these terms excludes liability the law does not allow to be excluded.

20. Indemnity

You agree to hold us harmless from any third-party claim brought because of you: because of text you wrote, a setting you configured, a use that breached these terms, or an infringement of someone else's rights.

21. Changes to these terms

We may change these terms. The date at the top of this page is the date of the last change.

A substantial change is announced on the site a reasonable time before it takes effect. Continuing to use the service after that is acceptance of it.

If you do not accept a change, the remedy is to stop using the service before it takes effect.

22. Disagreements

If a disagreement arises between us, the first step is to contact us through the support server: most of what looks like a dispute is a misunderstanding that one message settles.

We answer every message that reaches us, and we try to reach something both sides accept before any other step.

If that does not settle it, each party is free to pursue whatever the law that applies to them allows.
